All transactions between "dhya-shop.de" - owner Ingrid Thomas, also referred to hereafter as the Seller - and the party placing the order, hereafter referred to as the Buyer, are based on the following General Terms and Conditions of Business in their most recent German version at the time at which the order is placed.
Shipping Costs
The shipping rate within Germany is EUR 4.90 per order. Delivery is made by DHL package. All shipments are sent in plain packaging and the sender's name is private/undisclosed (no company names).
The shipping rate outside Germany is EUR 6.50 per order. Delivery is by Post AG or DHL. All shipments are sent in plain packaging and the sender's name is private/undisclosed (no company names).
Prices, Due Date, Payment, Default
The prices given at the time of placing the order apply. All prices include sales tax at the standard rate. On delivery of the order or receipt of the goods, the purchase price is due immediately and without discount.
Refusal of Orders
The Seller is entitled to refuse online orders. This decision is entirely at the discretion of the Seller. If the Seller decides not to complete an online order, he shall notify the customer immediately of this.
Retention of Title
Until all existing claims against the Buyer have been completely settled, the goods supplied remain the property of the Seller.
Set-off, Retention
A right to retention, set-off or reduction can only be exercised by the Buyer if possible counter-claims are legally established or the Seller has given explicit written consent.
Privacy
We know that you care how information about you is used and shared. Please know that we are not in the business of selling customer information. We use the information you provide for such purposes as handling your orders, customizing future shopping for you, improving our store and communicating with you. Your e-mail address is only used to respond to your requests and, if you wish, for our newsletter.
We do not submit your personal data to other third party services than the companies that perform functions on our behalf, like the Deutsche Post AG or our banks. They have access to personal information needed to perform their functions, but may not use it for other purposes.
You are entitled to get information, as well as to correct, lock and delete your recorded personal data. If you wish to do so please contact us per e-mail, phone or fax.
Personal information are collected and recorded solely within the scope of statutory provisions of the german data protection act as well as the informations and communications service act.

Sie können Ihre Vertragserklärung innerhalb von einem Monat ohne Angabe von Gründen in Textform (z. B. Brief, Fax, E-Mail) oder - wenn Ihnen die Sache vor Fristablauf überlassen wird - durch Rücksendung der Sache widerrufen. Die Frist beginnt nach Erhalt dieser Belehrung in Textform, jedoch nicht vor Eingang der Ware beim Empfänger (bei der wiederkehrenden Lieferung gleichartiger Waren nicht vor Eingang der ersten Teillieferung) und auch nicht vor Erfüllung unserer Informationspflichten gemäß § 312c Abs. 2 BGB in Verbindung mit § 1 Abs. 1, 2 und 4 BGB-InfoV sowie unserer Pflichten gemäß § 312e Abs. 1 Satz 1 BGB in Verbindung mit § 3 BGB-InfoV. Zur Wahrung der Widerrufsfrist genügt die rechtzeitige Absendung des Widerrufs oder der Sache.

Widerrufsfolgen
Im Falle eines wirksamen Widerrufs sind die beiderseits empfangenen Leistungen zurückzugewähren und ggf. gezogene Nutzungen (z. B. Zinsen) herauszugeben. Können Sie uns die empfangene Leistung ganz oder teilweise nicht oder nur in verschlechtertem Zustand zurückgewähren, müssen Sie uns insoweit ggf. Wertersatz leisten. Bei der Überlassung von Sachen gilt dies nicht, wenn die Verschlechterung der Sache ausschließlich auf deren Prüfung - wie sie Ihnen etwa im Ladengeschäft möglich gewesen wäre - zurückzuführen ist. Für eine durch die bestimmungsgemäße Ingebrauchnahme der Sache entstandene Verschlechterung müssen Sie keinen Wertersatz leisten. Paketversandfähige Sachen sind auf unsere Gefahr zurückzusenden. Sie haben die Kosten der Rücksendung zu tragen, wenn die gelieferte Ware der bestellten entspricht und wenn der Preis der zurückzusendenden Sache einen Betrag von 40 Euro nicht übersteigt oder wenn Sie bei einem höheren Preis der Sache zum Zeitpunkt des Widerrufs noch nicht die Gegenleistung oder eine vertraglich vereinbarte Teilzahlung erbracht haben. Anderenfalls ist die Rücksendung für Sie kostenfrei. Nicht paketversandfähige Sachen werden bei Ihnen abgeholt. Verpflichtungen zur Erstattung von Zahlungen müssen innerhalb von 30 Tagen erfüllt werden. Die Frist beginnt für Sie mit der Absendung Ihrer Widerrufserklärung oder der Sache, für uns mit deren Empfang.
Vom Widerrufsrecht ausgenommen sind:
Waren, die nach Kundenspezifikation angefertigt werden oder eindeutig auf die persönlichen Bedürfnisse des Käufers zugeschnitten sind.
Audio- oder Videoaufzeichnungen oder Software, wenn die gelieferten Datenträger vom Käufer entsiegelt werden.

Place of Jurisdiction
If the private end consumer is not resident in the European Union, our registered office is the place of jurisdiction. In transactions with end consumers inside the European Union, the law of the place of residence of the end consumer may apply, insofar as mandatory provisions of consumer law are concerned.
Partial Invalidity
Should individual provisions of these Terms and Conditions be invalid in part or in whole, the validity of the remaining provisions is not affected thereby. The appropriate legal regulations take the place of the invalid or missing provisions.
